Paralysis not considered as punishment
By the CNN Wire Staff
August 24, 2010 -- Updated 0241 GMT (1041 HKT)
STORY HIGHLIGHTS
* Saudi Arabia
(CNN) -- Saudi authorities backed away Monday from reports last week that a court was preparing to order a man paralyzed as punishment for paralyzing another man, allegedly in a fight.
The paralyzed man, identified by the Saudi newspaper Okaz as 22-year-old Abdul-Aziz al-Mitairy, requested the paralysis under sharia law, and, Okaz reported, the judge in the case had sent letters to several Saudi hospitals asking if they could sever a man's spinal cord.
But the Saudi Ministry of Justice denied that paralysis was ever considered as a punishment in the case, a high ranking Saudi government official told CNN.
The president of the court in the northwest province of Tabuk, where the incident took place, also disputed the reports.
"The proceedings in this case are still pending, and no verdict had been issued in that regards," Sheikh Saud Al-Yousef told Al-Riyadh newspaper.
Al-Yousef said the court had queried a number of hospitals and other authorities about surgical paralysis in order to convince the plaintiff about the impossibility of carrying out such a medical procedure.
"The plaintiff was demanding punishment of the attacker, and the judicial ruling in this case only includes the plaintiff's eligibility for blood money," he said.
Saudi news reports said last week that the Tabuk court debated how to carry out a paralysis sentence during proceedings in the case. News reports said that Riyadh's King Faisal Specialist Hospital, one of the country's top facilities, told the court it could not perform such a procedure.
But Amnesty International, which urged Saudi authorities not to carry out the punishment, said that at least one hospital said it would be possible to surgically paralyze the man.
Al-Mitairy told Okaz that the accused stabbed him in the back with a large knife during a fight more than two years ago.
"The accused confessed to the crime in front of police, resulting in a general sentence of seven months," he told the newspaper.
The alleged attacker, who has not been identified publicly, "was convicted and sentenced following a trial where he was said to have had no legal assistance," Amnesty said.
International human rights law would consider such a sentence to be a violation of the prohibition of torture and other cruel, inhuman or degrading treatment or punishment and to break the U.N. Convention Against Torture to which Saudi Arabia is a party, Amnesty said. It would also violate the principles of medical ethics adopted by the U.N. General Assembly, it said.
Other sentences of retribution in the kingdom have included eye-gouging, tooth extraction and death in cases involving murder, it said.
CNN's Mohammed Jamjoom, Amir Ahmed, Saad Abedine and Jen Deaton contributed to this story

We ordained therein for them: "Life for life, eye for eye, nose or nose, ear for ear, tooth for tooth, and wounds equal for equal." But if any one remits the retaliation by way of charity, it is an act of atonement for himself. And if any fail to judge by (the light of) what Allah hath revealed, they are (No better than) wrong-doers.

Tabuk High Court rejects paralysis punishment
By Nader Al-Enezi
TABUK – The High Court in Tabuk has rejected the demand of a plaintiff to hand down paralysis punishment to an attacker who left him paralyzed in a fight, sources told Okaz/Saudi Gazette.
Abdul Aziz Al-Mutairi, 22, wanted to have the spinal cord of the unidentified attacker damaged to leave him paralyzed.
Al-Mutairi also had one leg amputated as a result of the incident two-and-a-half years ago in which he was attacked with a cleaver.
The assailant was released after he spent seven months in prison.
“The verdict was issued rejecting the case filed by Abdul Aziz Al-Mutairi demanding like-for-like (Qisas) punishment of the perpetrator,” a source said of the matter, which has received international attention and pleas that the surgery not be performed.
“The court verdict was based on a medical report the court received from King Faisal Specialist Hospital in Riyadh saying it is impossible to conduct such an operation.”
The injured man was told by the High Court to accept the Shariah right, which is payment of blood money, but he objected. The case was referred to the Court of Appeals for final verdict and its reply is awaited, court sources said.
Saud Bin Sulaiman Al-Yusuf, president of Tabuk Region Courts, said the case has been delayed because of Al-Mutairi’s demand for paralysis punishment.
Al-Mutairi has said experts at King Khaled Hospital, which is located in Tabuk, told him that it is possible to perform the surgery.
King Khaled Hospital, however, said the operation can be done, but it would have to be performed at a specialist hospital.
Muhammad Al-Jad’an, a judge at the High Court, told Okaz/Saudi Gazette that officials wrote King Faisal Specialist Hospital in Riyadh to learn if it would be possible to operate on the assailant to sever his spinal cord and they said it could not be don.
The hospital said “inflicting such harm is not possible,” apparently refusing on ethical grounds. – Okaz/SG

Other sentences of retribution in the kingdom have included eye-gouging, tooth extraction and death among others.
I believe that if this issue was not picked-up by international news malamang natuloy ang lumpihan.

To kill the goodness in its followers. Go and continuously chant those verses while you sit moving your bodu back and forth.

Exodus 21:24 Eye for eye, tooth for tooth, hand for hand, foot for foot,
Exodus 21:27 And if he smite out his manservant's tooth, or his maidservant's tooth; he shall let him go free for his tooth's sake.

We ordained therein for them: "Life for life, eye for eye, nose or nose, ear for ear, tooth for tooth, and wounds equal for equal." Nakita mo iyong nasa bold and underline.
But if any one remits the retaliation by way of charity, it is an act of atonement for himself

Re: Islam Reality
I am just wondering, if the forgiveness you are talking about is equated with monetary payments.
Funny the authorities in KSA actually inquired in hospitals about severing of spinal nerves of the criminal. If the hospital agreed the first punishment by paralysis ma have happened.

But if any one remits the retaliation by way of charity, it is an act of atonement for himself

Re: Islam Reality
Read clearly your verses it does not say punishment...it says retaliation
Meaning Islam teaches retaliation.
Do not compare what is written in the Bible because we don't do those things. We have a better understanding of what is good and bad.

Exodus 21:24 Eye for eye, tooth for tooth, hand for hand, foot for foot,
Exodus 21:27 And if he smite out his manservant's tooth, or his maidservant's tooth; he shall let him go free for his tooth's sake.
Leviticus 24:20 Breach for breach, eye for eye, tooth for tooth: as he hath caused a blemish in a man, so shall it be done to him again.
Deuteuronomio 19:21 And thine eye shall not pity; but life shall go for life, eye for eye, tooth for tooth, hand for hand, foot for foot.
We ordained therein for them: "Life for life, eye for eye, nose or nose, ear for ear, tooth for tooth, and wounds equal for equal." But if any one remits the retaliation by way of charity, it is an act of atonement for himself. Huh! Christians do not do those gory things, You really do not know the Christian ways.
Look what Islam teaches you...Retaliation. Vengeance...
Christians have no choice but to forgive.

42:39. And those who, when an oppressive wrong is inflicted on them, (are not cowed but) help and defend themselves.
42:40. The recompense for an injury is an injury equal thereto (in degree): but if a person forgives and makes reconciliation, his reward is due from Allah. for ((Allah)) loveth not those who do wrong.
42:41. But indeed if any do help and defend themselves after a wrong (done) to them, against such there is no cause of blame.
42:42. The blame is only against those who oppress men and wrong-doing and insolently transgress beyond bounds through the land, defying right and justice: for such there will be a penalty grievous.
42:43. But indeed if any show patience and forgive, that would truly be an exercise of courageous will and resolution in the conduct of affairs.

"Paralysis for Paralysis".

Proverbs 25:21 (NIV)
21 If your enemy is hungry, give him food to eat; if he is thirsty, give him water to drink.
Romans 12:17 (NIV)
17 Do not repay anyone evil for evil. Be careful to do what is right in the eyes of everybody.
Exodus 22:2–3 (NIV)
2 “If a thief is caught breaking in and is struck so that he dies, the defender is not guilty of bloodshed; 3 but if it happens after sunrise, he is guilty of bloodshed. “A thief must certainly make restitution, but if he has nothing, he must be sold to pay for his theft.
When a thief breaks into someone’s house at night and that person
defends his home and slays the thief, God does not hold that death over
the defender’s head. However, God does not wish for anyone to take law
into his or her own hands. This is why it is said that if a thief is
struck down during the daylight the defender is guilty of
bloodshed. Now
this is speaking of thievery, not an attack. So if the thief were to
attack the defender even during the day, self-defense would be
justified.
1Co 6:19-20
19 Or know ye not that your body is a temple of the Holy Spirit which is in you, which ye have from God? and ye are not your own; 20 for ye were bought with a price: glorify God therefore in your body. (1Co 6:19-20 ASV)
Our bodies are His property and so we are not permitted to treat or destroy them.
21 If your enemy is hungry, give him food to eat; if he is thirsty, give him water to drink.

If your enemy is hungry, give him food to eat; if he is thirsty, give him water to drink.
Do not repay anyone evil for evil.
